Terms of Service

1. Acceptance
By creating an account or using brandex.app (the "Service"), you agree to these Terms.
2. Your account
You are responsible for activity on your account and for keeping credentials secure. You must be at least 16 years old.
3a. Third-party URLs and content analysis
You may submit URLs to publicly available websites for analysis. You are solely responsible for ensuring that you have the right to access, analyze, and use the content available at any URL you submit. We do not claim ownership of any third-party content, and we do not store, reproduce, or redistribute the full text, images, or other raw materials from those websites. We store only the AI-generated analysis, summaries, and structured brand insights you request for your own use.
4. Your content
You retain all rights to content you submit. You grant us a limited license to host, process, and display it solely to operate the Service for you. We do not train shared AI models on your private content.
5. AI outputs
AI outputs are generated from third-party models and are provided as-is. You are responsible for reviewing outputs before publication.
5a. AI transparency (EU AI Act, Article 50)
Images, video, audio, and text produced through the Service are synthetic content generated by AI systems. Where you publish or distribute such content, you are responsible for disclosing to your audience that it is AI-generated or AI-manipulated, and for applying any labelling required in your jurisdiction — including Article 50 of the EU AI Act for content that depicts real people, events, or places in a realistic way.
The Service attaches provenance metadata (content credentials, including a cryptographic fingerprint of the asset and its generation history) to generated assets where technically feasible, and provides compliance checks that can flag missing AI disclosures. These are assistive tools; they do not remove your obligation to review and label published content. Any AI assistant or chat feature within the Service is identified as an AI system at the point of interaction.
6. Third-party integrations
Connected providers (Meta, Google, HubSpot, TikTok, etc.) are governed by their own terms. We are not responsible for their availability or data quality.
7. Fees
Paid plans are billed in advance and non-refundable except where required by law. We may change pricing with 30 days' notice.
8. Termination
You may cancel at any time. We may suspend or terminate accounts that violate these Terms or pose a risk to the Service. See User Data Deletion.
9. Disclaimers & liability
The Service is provided "as is" without warranties. To the maximum extent allowed by law, our aggregate liability is limited to the fees paid in the 12 months preceding the claim.
10. Governing law
These Terms are governed by the laws of the jurisdiction in which Brandex is registered. Disputes are resolved in that jurisdiction's courts.
11. Changes
We may update these Terms; material changes will be notified by email.
